The Error With Pilot Error

Alliance Air B-737 200 that recently crashed in Eastern India killing 55 people. A local Johannesburg daily had a half page article on the accident "However, a top Civil Aviation official indicated pilot error could have caused the crash, in which none of the crew survived". Well it's easier to blame the crew, especially as they are not here to defend themselves. But what purpose has this in an accident investigation? I think it's shocking to even quote the person. “Could have” is total speculation, it shouldn’t be quoted because this speculation becomes truth to many.
